<p>As the <strong>ObamaReleaseYourRecords</strong> blog reports, Ohio Birther <strong>Susan Daniels, P.I.</strong> got a reality check from Geauga County Prosecuting Attorney, David Joyce:</p>

<p>Daniels follows in the footsteps of other illustrious <strong> Birthers</strong>, such as<strong> Orly Taitz</strong>,  <strong>Sheriff Joe Arpaio</strong>, and the entire Cold Case Posse, in failing to check out the criminal statutes<strong> BEFORE</strong> alleging a crime has been committing, and gathering the requisite evidence <strong>BEFORE</strong> running off to the fuzz.  Or running off at the mouth.</p>
<p><strong>Daniels</strong> is the <em>alleged</em> private investigator whose sloppy investigatory skills help start the whole <strong>Obama has 39 social security numbers</strong> Birther claim several years ago:</p>

<p>Her partner in stupid, Neil Sankey, had enough sense to realize that the database search didn&#8217;t prove anything because none of it could be linked to Obama.  But <strong>Daniels</strong> is the really slow learner of the pair, and has yet to grasp that  simple fact.  Compounding those failures is an inability to read and comprehend easy statements written in English. <strong>Daniels</strong> has been carrying on to beat the band that there is something fishy about Obama having a Connecticut social security number. My personal guess is that someone at the Social Security Administration made a typo back in 1977. It doesn&#8217;t matter because as the SSA states:</p>
<blockquote><p>Since 1972, when SSA began assigning SSNs and issuing cards centrally from Baltimore, the area number assigned has been based on the ZIP code in the mailing address provided on the application for the original Social Security card. The applicant’s mailing address does not have to be the same as their place of residence.   Thus, the Area Number does not necessarily represent the State of residence of the applicant, either prior to 1972 or since.</p></blockquote>
<p>In spite of this, Daniels went ahead and filed a Birther eligibility suit in Ohio. When she realized that the suit was about to be dismissed, and she would not be getting any more attention, she filed another claim with the courts requesting an identity theft criminal investigation because of the social security number.  Unfortunately for <strong>Ms. Daniels</strong>, The Geauga County prosecuting attorney CAN read and he told her the same thing as the SSA did, on page two of his letter. <p>To add a little extra twist to the knife, David Joyce is a Republican. As she whines in the ORYR link above:</p>
<blockquote><p><em>We are in serious trouble when a Republican prosecutor, David Joyce, who is now running for congress, does not care enough to look into a felony being committed by Barack Obama. The information in the letterfrom the SSA was added after I discovered that Obama is using a fraudulent social security number. The residence had to be in the state where the number was issued. They are lying. The issue could be cleared up by the prosecutor sending a letter to the SSA asking for a copy of the original application that goes with xxx-xx-4425. Apparently, that was too much trouble.</em></p></blockquote>
<p>No. Actually, it is Daniels&#8217; idiotic claim that is in trouble.  This is what happens every time that grown-ups have to deal with Birther silliness. But, she is way too much of an attention-whore to just shut up and go away. I wonder what she will try next???</p>

<p>Just the other day the Birther blog, <strong>Birther Report</strong> breathlessly reported that &#8220;CBS NEWS&#8221; was calling for Obama to release documents and questioning whether he was a foreign exchange student.</p>

<p>Come to find  out, Scott Paulson was just another blogger posting at a local CBS news website. I let that one pass.  Now, <strong>Birther Report</strong> has this story up, wherein Yahoo News is supposedly pimping some silly Birther book:</p>

<p><strong>Birther Report</strong> isn&#8217;t out and out lying, but they are dissembling:</p>
<blockquote><p>dis·sem·ble (dî-sčmąbel)  verb, transitive 1. To disguise or conceal behind a false appearance. 2. To make a false show of; feign. verb, intransitive To disguise or conceal one&#8217;s real nature, motives, or feelings behind a false appearance.</p></blockquote>
<p>Why would anybody think that Yahoo News had any<em> independent</em>  interest at all in something like this:</p>

<p>Here is how it works:</p>

<p>So, neither CBS News or Yahoo News were behind the respective stories. Yahoo News got it from some third party. Who knows whether money changed hands at that level or not. So why would Birther Report do something like this???  Why didn&#8217;t they just run a story about the book without all the Yahoo News gloss???</p>
<p>I think it is for the same reason World Net Daily and all the Birther blogs hopped on the &#8220;<em><strong>Israeli science website says&#8221;</strong> </em>story a few weeks back? It was an attempt to portray a non-existent consensus behind the story. This is a form of logical fallacy:</p>
<blockquote><p>This type of argument is known by several names,  including appeal to the masses, appeal to belief, appeal to the majority, democracy, argument by consensus, consensus fallacy,authority of the many, and bandwagon fallacy, and in Latin as argumentum ad numerum (&#8220;appeal to the number&#8221;), and consensus gentium (&#8220;agreement of the clans&#8221;). It is also the basis of a number of social phenomena, including communal reinforcement and the bandwagon effect. The Chinese proverb &#8220;three men make a tiger&#8221; concerns the same idea.</p>
<p>This fallacy is similar in structure to certain other fallacies that involve a confusion between the <em>justification</em> of a belief and its <em>widespread acceptance</em> by a given group of people. When an argument uses the appeal to the beliefs of a group of supposed experts, it takes on the form of an appeal to authority; if the appeal is to the beliefs of a group of respected elders or the members of one&#8217;s community over a long period of time, then it takes on the form of an appeal to tradition.</p></blockquote>
<p>The truth is, the only people who really believe the<strong> Birther</strong> nonsense are other <strong>Birthers</strong>. When the mainstream press notices these kind of stories,  it is for the same reason they do stories on Honey Boo Boo. So that <em>normal</em> people can marvel at some of the <em>abnormal</em> people who make up the human race.  Or, with Birthers, to drive a few more people to voting for Democrats next month.</p>

<p>You see, that is the thing about frivolous lawsuits. They&#8217;re only fun when you don&#8217;t have to pay for the other guy&#8217;s lawyer. The way things work with Rule 11, (See Note 2 below.) is that a party has this duty:</p>
<blockquote><p>The signature of an attorney or party constitutes a  certification by him that he has read the pleading, motion or other paper; that to the best of his knowledge, information, and belief formed after reasonable inquiry it is well grounded in fact and is warranted by existing law or a good faith argument for the extension, modification or reversal of  existing law, and that it is not interposed for any improper purpose, such as to harass or to cause unnecessary delay or needless increase in the cost of litigation.</p></blockquote>
<p>That is NOT a really high bar. All you have to do is have a sensible case based on a reasonable reading of the law. But Dr. House must have figured he stood to lose under this standard. Sooo, he exercised some good sense and got out while he was ahead. What this shows is that House knew darn good and well that he had filed a frivolous suit and just didn&#8217;t want to pay the price.</p>
<p>What a scoundrel and what a cheapskate. What was that sanctimonious crap he was spewing a few weeks ago (See Note 3 below.):</p>
<blockquote><p>I am not a “birther.” I am a constitutionalist.</p>
<p>The Constitution either means what it says or is relegated to the dustbin of history. The U.S. Supreme Court has the imperative duty to resolve the issue of “natural born citizen” once and for all. This is an intellectual, legal and historical question that is very pertinent today.</p>
<p>Seasoned and brilliant legal scholars share sober opinion on both sides of this debate. It is, then, plainly clear that the U.S. Supreme Court should be presented this case so that a final answer can be had. My effort intends just and only that.</p></blockquote>

<p>Thank you for taking the time to write and for the concerns you have expressed. There are a couple of points of analysis, though, in determining whether a criminal charge can be filed, regardless of the charge or who the suspect might be. The first is whether I have jurisdiction over the case. That requires that some conduct had to have occurred in Maricopa County for me to have jurisdiction. From the Sheriff&#8217;s Office investigation into suspect documents produced by the White House to date, that investigation has not revealed any evidence that conduct occurred in Maricopa County. I have discussed this with the Sheriff. As for any issues regarding qualifications or information provided regarding the Presidential Election itself, that is a statewide election. Under Arizona law, the Secretary of State and the Attorney General have jurisdiction over statewide elections. I do not.</p>
<p><strong>I will share with you, as well, that the criminal statute you cited in your message requires additional evidence that the MCSO investigation to date has not uncovered. Specifically, we would need evidence to affirmatively prove that Mr. Obama is not a US citizen. To date, there has been evidence presented leading to speculation that documents have been forged and other documents do not exist. That alone, though, is not sufficient evidence to present to a grand jury and actually have a reasonable likelihood of conviction. </strong> I cannot speak for other prosecutors at the state level around the rest of the country or for prosecutors at the federal level but Arizona?s ethics rules do not permit prosecutors to file a charge they can only hope to be able to prove beyond a reasonable doubt at a later stage.</p>
<p>I stand ready and willing, however, to review any case submitted for charges and, if the evidence is there, I will prosecute regardless of who the suspect/defendant may be.</p>

<p>Birthers should not be surprised that there is insufficient evidence for prosecution. I patiently explained this to them in a previous  Internet Article:</p>
<blockquote><p>Others, like Dr. Orly Taitz, Esq. and numerous Freeper Birfers, are filled with indignation because the saner part of the universe simply ignores Arpaio and the Cold Case Posse’s claims of forgery. Sooo, I have decided to deconstruct the issue and get down to specifics. First, let us get a workable definition of<strong>forgery</strong>. This one, from the Free Legal Dictionary, seems typical:</p>
<p>The <strong>creation of a false written document</strong> or <strong>alteration of a genuine one</strong>, <strong>with the intent to defraud.</strong></p>
<p>Forgery consists of filling in blanks on a document containing a genuine signature, or materially altering or erasing an existing instrument. <strong>An underlying intent to defraud</strong>, based on knowledge of the false nature of the instrument, <strong>must accompany the act</strong>.</p>
<p>Since the word <strong>defraud</strong> is used twice, let’s define that word also, from the same source:</p>
<p>[T]o use deceit, falsehoods, or trickery to obtain money, an object, rights or anything of value belonging to another.</p>
<p>Legally, any erroneous information would have to have been put in, or altered,  <em><strong>with the intent to defraud</strong></em>, so that simple clerical errors or harmless mistakes would <em>not</em> constitute forgery. For example, if a clerk penciled in the number “9″ for the Father’s Race, when the correct code should have been “2″, there is no forgery.  Mainly, because there was no evil intent and no one is being defrauded of anything.</p>
<p>I would submit that Sheriff Joe, Deputy Zullo, The Cold Case Posse, Jerome “Jerry” Corsi, and other Birthers have completely and utterly failed to prove any of the elements of a forgery claim. Not only have they failed to substantially <strong>prove</strong> any of the forgery elements, they have not even made a credible <em> allegation</em> of any element of forgery.</p></blockquote>

<p>IIRC, back in 2010 about 58% of the country had some degree of doubt about where Obama was born. Now, that number is down to about 40%, but seems to be holding firm at that level. The comments at the above link are good, too.</p>

<p>&#8220;Hassan’s challenge to the Fund Act rests on his contention that the natural born citizen requirement has been implicitly repealed by the Fifth and Fourteenth Amendments. The Court need not repeat the thorough and persuasive opinions issued by its colleagues in at least five other jurisdictions, all of whom determined that the natural born citizen requirement has not been implicitly repealed by the Fifth and Fourteenth Amendments.&#8221;</p>
<p>&#8220;Moreover, the Supreme Court has consistently held that the distinction between natural born citizens and naturalized citizens in the context of Presidential eligibility remains valid.&#8221;</p>
<p>&#8220;Because the natural born citizen requirement has not been explicitly or implicitly repealed, Hassan’s challenge to that provision, and the Fund Act’s incorporation thereof, must fail.&#8221;</p></blockquote>

<p>The Birther take on this that YIPPEE, SEE ARTICLE II STILL APPLIES!!! THE !$TH AMENDMENT DIDN&#8217;T CHANGE THINGS AFTER ALL!!! Well, nobody on this side ever said Article II didn&#8217;t apply. It is the Birthers who either can&#8217;t, or won&#8217;t, understand the underlying concepts. The simple fact is that far from NOT REPEALING the natural born citizenship requirement for the Presidency, the 14th Amendment actively  AFFIRMED the common law concept of birthright citizenship, also known as natural born citizenship. From the SCOTUS decision in<strong> Wong Kim Ark (1898)</strong>, near the bottom of Section V:</p>
<blockquote><p>The foregoing considerations and authorities irresistibly lead us to these conclusions: the Fourteenth Amendment affirms the ancient and fundamental rule of citizenship by birth within the territory, in the allegiance and under the protection of the country, including all children here born of resident aliens, with the exceptions or qualifications (as old as the rule itself) of children of foreign sovereigns or their ministers, or born on foreign public ships, or of enemies within and during a hostile occupation of part of our territory,[wild Indian exception omitted.]</p>
<p>The Amendment, in clear words and in manifest intent, includes the children born, within the territory of the United States, of all other persons, of whatever race or color, domiciled within the United States. <strong>Every citizen or subject of another country, while domiciled here, is within the allegiance and the protection, and consequently subject to the jurisdiction, of the United States.</strong> His allegiance to the United States is direct and immediate, and, although but local and temporary, continuing only so long as he remains within our territory, is yet, in the words of Lord Coke in Calvin’s Case, 7 Rep. 6a, “strong enough to make a natural subject, for if he hath issue here, that issue is a natural-born subject;”</p></blockquote>
<p>and, this case cited with approval by the <strong>Wong Kim Ark Court:</strong></p>
<p>&#8220;In <strong>United States v. Rhodes (1866)</strong>, Mr. Justice Swayne, sitting in the Circuit Court, said:</p>

<p>What the heck is sooo darn hard about that??? If you are born here, you are &#8220;in the allegiance&#8221; of the United States regardless of the citizenship of your parents. If you are born here in the allegiance, or under the jurisdiction of the United States, then you are a natural born citizen. Period. End of story. From WKA:</p>

<p>Paraphrasing <strong>ORYR&#8217;s</strong> favorite quote, the only people who don&#8217;t get this, are people  who don&#8217;t want to get it. The Birthers have been lying and dissembling about this simple legal fact for 4 years. It started with <strong>Ankeny</strong> in Indiana back in 2008.</p>

<p>No, there wasn&#8217;t a difference. Something like 7 or 8 subsequent courts have held the same thing. Sooo, of course the 14th Amendment didn&#8217;t overturn the  Article II Presidential requirement. It was way too busy affirming the underlying common law concept of natural born citizenship..</p>

<p>Holy Crap! This stuff sucks!!! If there&#8217;s a <strong><em>barker</em></strong> somewhere, its that alleged song. Or more likely,  some sort of demented  <em><strong>howler</strong></em>. Mr. Judy could probably find a market for these songs with 7-11 or some other place that wants to run teenagers off the parking lot. The problem is that it would chase away the customers, too. And drive the clerks insane.</p>
<p>Maybe police departments could use these to break up demonstrations like the Occupy movement??? It would be a lot cheaper than water cannons, but I can see the polizei heading for the hills, too. Heck, entire downtowns would empty out in a hurry. If there is a dog in your neighborhood who barks too much, take either of these songs and play them when the dog starts to bark. Poor Fido will run squealing to a far corner of his yard and bury his head in the dirt. Do it twice, and he will bark no more, forever.</p>
<p>I have some advice for Mr. Judy, and I have put it in the form of a song. I could have written an entire song, but I am afraid Mr. Cody would sing it and put it out on youtube. I don&#8217;t want to be responsible for that. Sooo, I just did a single refrain.</p>

<p>Meanwhile, <strong>Zullo</strong> seems to have developed some sort of weird <strong>Harold and Maude-ish</strong> attraction to an old lady in a Hawaii nursing home in the hope that she remembers something fishy about a birth certificate from 51 years ago.</p>
<p>About the only Birther who is still out there pitching and hitting anymore is <strong>Dr. Orly Taitz, Esq.</strong>, and half or more of the Birthers don&#8217;t  expect her to accomplish anything.</p></blockquote>
<p>It seems to me like all the fire has just gone out of their bellies. Could it be the constant judicial disappointments??? Could it be the prolonged failure to find any substantial evidence to back up their suspicions??? Could it be the failure of the Republican establishment to buy into their fantasies???  Or, could it be the well-reasoned and abundant criticism heaped on them by all of  us Anti-Birthers and Obots???</p>
<p>I don&#8217;t doubt that there are still millions and millions of them out there, and that Birtherism has become an article of faith to them. But,  have they become like the <strong><em>Easter</em> Christians </strong>whose faith is so weak they only make it to church once a year or so, if nothing else is going on that day? Here we are about a month out from the election, and Birtherism seem to have blown a fuse. If the<strong> Birthers</strong> stay stirred up, and indignant, they could still play a big part in making Obama a one-term President. But, if they have grown bored with the whole Birther thing, then who knows?</p>
<p>Looking at the Birther agenda for October, there does not seen to be a Revival tent meeting anywhere on it.</p>

<p><strong>Note 1. The Image.</strong> This is <strong>Sid Caesar</strong> playing <strong>Dentist Melvin Crump</strong> from the <strong>1963</strong> film,  <strong>It&#8217;s A Mad, Mad, Mad, Mad World.</strong>  Directed by Stanley Kramer, this is probably the funniest movie ever made.  Wiki says:</p>

<p>Two detectives (main, Norman Fell; supporting, Nicholas Georgiade) arrive, with the main detective asking those five, who descended the hill to the accident site, some pointed questions about their interaction with Grogan. While not so artfully dodging the questions, each of the five internally changes from having had compassion for Grogan to becoming resolved to retrieve the treasure. Then the detectives permit the five to return to their vehicles after demanding and receiving Finch&#8217;s contact information. The motorists then drive away from the accident site and initially test each other&#8217;s resolve on the road, then stop to try to reason with one another on how to share the money, but when they can&#8217;t agree on any one particular distribution, they return to their vehicles to engage in an all-out race to reach the loot first.</p></blockquote>

<p>They must be getting desperate over at  WND, because the citizen grand jury Birther game is so old and toothless most Birthers won&#8217;t even fall for it. The scam was popular for a while several years ago. For example, see this article from April 2009:</p>

<p>The only thing remotely interesting about the announcement is the title  (<em><strong>Life After Romney And The Republicans</strong></em>)  and the  catty little remark about Mitt  and the  GOP, &#8220;<strong><em>Forget about Mitt Romney and the Republican Party; their game is up. We can save the nation and live without them, so help us God.</em></strong>&#8221; I sense that<strong> Klayman</strong> is a little miffed about the Republican grown-ups ignoring the silly, childish Birther stuff.  Sooo, we get the histrionic, whiny, little, &#8220;Who needs them, we&#8217;ll just do it all by ourselves!&#8221; mantra. Yeah, and next the Birthers will hold their breaths until they turn blue, and  run away and join the circus. Oh wait, they already joined the circus.</p>
<p>Anyway, I guess <strong>Larry &#8220;Klutz&#8221; Klayman</strong> does not intend to ever practice real-world, serious law again. Perhaps he is thinking of a new career in acting, or maybe stand-up comedy???  If he appears at your door on Halloween night in his little junior lawyer costume, don&#8217;t give him any of the good candy.</p>

The name of the group is <em><strong>The White Rose!</strong></em> The original Internet Article was scrubbed, but I managed to get a copy of it anyway.  It looks like somebody accidentally posted the article and then realized they had let the cat out of the bag. There was even an abortive posting at Free Republic, but that was pulled also.</p>

<blockquote><p>Johnson is best known for his work on Rowan &amp; Martin&#8217;s Laugh-In, an American television series (1967–1973), on which he played various characters including &#8220;Wolfgang&#8221;, a smoking World War II German soldier scouting the show from behind a bush (still fighting the war) invariably commenting on the preceding sketch with the catchphrase &#8220;Very interesting&#8230;&#8221; followed by either a comic observation or misinterpretation, or simply &#8220;but stupid!&#8221; Johnson indicated later that the phrase came from Desperate Journey, a 1942 World War II film with Errol Flynn and Ronald Reagan playing Royal Air Force pilots shot down in Nazi Germany; they managed to cross much of the country without speaking German or knowing the territory but, when captured, their Nazi interrogator doubts their story with the phrase.† Johnson reprised the role while voicing the Nazi-inspired character Virman Vunderbarr on an episode of Justice League Unlimited.</p>
<p>† Johnson was somewhat incorrect in his recollection of the details of this movie, and his faulty recollection was subsequently misquoted and widely repeated on the Internet, further distorting the origin of the phrase. In the movie, after getting shot down and captured, an English-speaking German officer played by Raymond Massey interrogates the flyers. During the interrogation, they see through a window some nearly-assembled aircraft being transported on trucks, and the Raymond Massey character says “I see you find that view most interesting … too bad you saw that, now you can not be even considered for exchange…” but it was not spoken doubting any story told by the flyers. The flyers escape from the interrogation and begin their “journey” across Germany and The Netherlands, traveling towards the English Channel in stolen vehicles while wearing stolen German uniforms. Along the way, they have several violent engagements with German troops and commit sabotage; they are actively pursued by the Raymond Massey character and at the end commandeer a British bomber previously captured by the Germans and fly it back to England, without any German remarking, to either the flyers or to another German: “Very interesting &#8230; ” and, the Errol Flynn character is fluent in German. It is possible that the actual source of the phrase is the movie “Berlin Correspondent” (use of the phrase in the movie is reported but unverified) and that Johnson had confused elements of the two movies and/or misremembered aspects of them.</p></blockquote>

<p><strong>Note 2. The Caption.</strong> P.I. can stand for Private Investigator, or Public Intoxication. Far different than <strong>White Rose</strong>, Richards <strong>Wild Irish Rose</strong> is a quintessential <strong>bum wine</strong>. <strong>Wiki</strong> explains:</p>
<p>An early reference to the problem of cheap and poorly made wines is in the &#8220;Report on Cheap Wines&#8221; in the 5 November 1864 issue of <em>The Medical Times and Gazette</em>. The author, in prescribing inexpensive wines for a number of ills, cautions against the &#8220;fortified&#8221; wines of the day, describing of one sample that he had tried:</p>
<blockquote><p>&#8220;When the cork was drawn it was scarcely tinted, and was a very bad one – a thing of no good augury for the wine. There was no smell of port wine. The liquid, when tasted, gave the palate half-a-dozen sensations instead of one. There was a hot taste of spirits, a sweet taste, a fruity taste like damsons, and an unmistakable flavor of Roussillon [an alternative name in France for wine made from the grape Grenache]. It was a strong, unwholesome liquor, purchased very dearly.&#8221;[</p></blockquote>
<p>It is reported, however, that the popularity of cheap, fortified wines in the United States arose in the 1930s, as a product of Prohibition and the Great Depression:</p>
<blockquote><p>&#8220;Prohibition produced the Roaring Twenties and fostered more beer and distilled-spirit drinkers than wine drinkers, because the raw materials were easier to come by. But fortified wine, or medicinal wine tonic—containing about 20 percent alcohol, which made it more like a distilled spirit than regular wine—was still available and became America&#8217;s number one wine. Thunderbird and Wild Irish Rose, to name two examples, are fortified wines. American wine was soon more popular for its effect than its taste; in fact, the word wino came into use during the Depression to describe those unfortunate souls who turned to fortified wine to forget their troubles.&#8221;<br />

<p>More recently, the appeal of cheap fortified wines to the poor and homeless has raised concerns:</p>
