One of the good things about being an Anti-Birther as opposed to being an Obot is that we still get to enjoy Obama’s various trips and stumbles. And OH, has he done it now. Breitbart broke the news today that in 1991, Obama was presented by his literary agent as being “born in Kenya, and raised in Hawaii and Indonesia.” Here is a copy:

Like the people at Breitbart, I do not believe that this trumps a Hawaiian Birth Certificate, but this definitely breathes new life into the Kenyan Birth Birthers, and it is now going to be even more hopeless trying to convince them otherwise. I do not believe that this is something which simply slipped by Obama without his knowledge. Bluntly, Obama has just been caught fibbing once again about his past. Shades of Elizabeth Warren!!!
UPDATE: The literary agent who wrote the above blurb states that she simply made a fact checking error and had no input from Obama, which would indicate that Obama wasn’t fibbing. Here is her statement and a link to it:
Miriam Goderich just issued a statement to the Political Wire saying the future president never suggested “in any way that he was born in Kenya and not Hawaii”:
“You’re undoubtedly aware of the brouhaha stirred up by Breitbart about the erroneous statement in a client list Acton & Dystel published in 1991 (for circulation within the publishing industry only) that Barack Obama was born in Kenya. This was nothing more than a fact checking error by me — an agency assistant at the time. There was never any information given to us by Obama in any of his correspondence or other communications suggesting in any way that he was born in Kenya and not Hawaii. I hope you can communicate to your readers that this was a simple mistake and nothing more.”
Whatever, all this still has nothing whatsoever to do with the idiotic two citizen parent Birther legal theory. However, I predict we will now be seeing this latest flap/revelation appearing in the various Birther legal filings.
The fallout should be interesting.

The fallout came quick this morning on the radio from the two birther hosts on the “Sean and Frank Show” on WCBM (AM 680). They contend either the literary agent was lying then or is lying now about the bio. And if it was a “fact checking error” where did the facts came from if Obama himself didn’t dictate it.
And, of course, Sean Casey used the segment to iterate his belief that, while that he thinks Obama was born in Hawaii, he is ineligible for President because his fater wasn’t an American citizen. I had written to him before on this only to find his reply is a Minor v. Happersett quote-mine from Apuzzo.

Let’s assume it was a fact check error. Some people are saying that since it wasn’t corrected until later, the claim that it wasn’t noticed doesn’t make sense. I think it was noticed but there was no reason to spend a bunch of money to recall a bunch of booklets for such an error. It was only until Obama got into politics that his birthplace became an issue.
I can’t go with “Obama submitted the wrong information”. There no evidence that he ever claimed to be born in Kenya, and being born in the US is a better narrative for him anyway.

This will show up in a lawsuit, probably to file an Emergency Amended Demand for Reconsideration of Court XYZ Tossing the 137th birther suit into the garbage can because it is not based on facts or law. I predict it will garner motions for sanctions if/when it does appear. Orly Taitz has already added it to a draft she is preparing to file in a case now in Mississippi US District Court. The lack of veracity of the pamphlet is unimportant to birthers, as is the fact the author has said it is an Error. All birthers care about is something Apuzzo called “Totality”. Their pile of inauthentic hearsay and fake “expert” testimonials are gibberish. The 2 parent gag has been demolished by every court who has heard it. The rest of birthers’ “case” is suspicions of crazy/racist, outright lies, and wild speculations all piled upon each other in a jumbled mess – and NONE of it meets the standards of Evidence. But..they wholeheartedly believe this erroneous pamphlet added to the “Totality” of their pile of useless nonsense and gibberish makes their “case” that much stronger.
It’s pure nutsville.

On August 8, 2011 the Birther Summit issued a challenge to Gen. Colin Powell (Ret) to review a mountain of evidence clearly demonstrating the birth certificate officially released by the White House and posted on its server on April 27, 2011 was a forgery.
Nine days later, the Arizona “Surprise Tea Party” collected 242 signatures on a petition requesting Sheriff Joe Arpaio of Maricopa County, Arizona to conduct an investigation into the birth certificate posted on the White House servers on April 27, 2011.
One man honored his Oath of Office by immediately launching an investigation, while the other dismissed “We the People’s” challenge in classic Alinsky style — ridicule.

A federal court in Washington, DC, held last week that political appointees appointed by President Obama did interfere with the Department of Justice’s prosecution of the New Black Panther Party.
The ruling came as part of a motion by the conservative legal watch dog group Judicial Watch, who had sued the DOJ in federal court to enforce a Freedom of Information Act (FOIA) request for documents pertaining to the the New Black Panthers case. Judicial Watch had secured many previously unavailable documents through their suit against DOJ and were now suing for attorneys’ fees.
Obama’s DOJ had claimed Judicial Watch was not entitled to attorney’s fees since “none of the records produced in this litigation evidenced any political interference whatsoever in” how the DOJ handled the New Black Panther Party case. But United States District Court Judge Reggie Walton disagreed. Citing a “series of emails” between Obama political appointees and career Justice lawyers, Walton writes:
The documents reveal that political appointees within DOJ were conferring about the status and resolution of the New Black Panther Party case in the days preceding the DOJ’s dismissal of claims in that case, which would appear to contradict Assistant Attorney General Perez’s testimony that political leadership was not involved in that decision. Surely the public has an interest in documents that cast doubt on the accuracy of government officials’ representations regarding the possible politicization of agency decision-making.

In sum, the Court concludes that three of the four fee entitlement factors weigh in favor of awarding fees to Judicial Watch. Therefore, Judicial Watch is both eligible and entitled to fees and costs, and the Court must now consider the reasonableness of Judicial Watch’s requested award.
